Judicial Appointments: How should the Republicans handle it? A Blogger Symposium

The other great thing is to invite debate.
Hugh Hewitt, a great presence in the Blogsphere as well as Law Professor, Author and Talk Radio host, invited Bloggers this weekend to comment on the coming Senate debate on Judicial appointments. (By the way, if you want to know more about Blogging, may I suggest Hewitt’s book, Blog.) The title of this debate: Vox Blogoli 2.2: Does the Senate GOP Go McClellan or Grant if Harry Reid "Goes Gingrich?"
In other words: How should the Senate Republicans confront the threatened Democrat filibuster either by caving in to it or by changing the rules back to simple majorities winning (as opposed to 60 votes to confirm), also called the “nuclear option”.
He sums it up this way: respond like McClellan (always preparing for battle, but avoiding it) or Grant (fight, then fight, then fight again in order to win).
I think it is worth noting that less than 5% of the respondents to this call for opinions believes that the Democrats should be accommodated.

I am constantly amazed at the sheer magnitude and quality of thought that this country holds and blogging taps into. The Mainstream Media doesn’t believe it at all.

Will the Republicans ever learn the basic law:
You do not negotiate with the Democrats, you out vote them.
Change the Senate rules as follows:
1. Majority vote carries.
2. If the Senate does not vote NO for a judicial appointment in 90 days of the nomination, the appointment is approved by default.
These are within the jurisdiction of the senate rules that can be changed by a majority vote.
We have that majority, why not use it.
I think the Republicans should adopt thr simple majority rule. The appointment of more liberal judges will spell the demise of our country as our founding fathers envisoned it. The effect of legislation by judicial decree is the cause of a multitude odf our nations ills. One example is the lack of discipline in our schools, which is undermining the education of our youth. The school boards refuse to enforce discipline and dress codes for fear of lawsuits by the ACLU and liberal parents. A conservative slate of judges could throw these frivolous lawsuits out of court and fine the attorney’s who brought them to the court. Then put individuals with a modicum of common sense and some backbone on the school boards.
I believe that the senate should no longer bow down to Democrats. If they start filibusterin again the rules should be changed so that all candidates would be put before the whole senate. We need judges who would not be activist and make laws. Laws are to be made by representative government, not judges.
