Yet again, the Chronicle editorial board has decided to ignore the text of the Constitution. It’s easier to just make stuff up:
Today’s president argues that the Constitution grants implied powers to the commander in chief that cannot be infringed, even by the explicit provisions of the Constitution such as the Fourth Amendment, which forbids warrantless searches and makes no exception for wartime.
Did you know that a cop can frisk you upon arrest, even without a warrant? That’s because the Fourth Amendment forbids unreasonable — not merely warrantless — searches.

I don’t recall the word warrant appearing ANYWHERE in the constitution.
OK, Matt corrected me (I guess I oughtta follow the linky before inserting foot.) it does appear, however, it does not specifically say that is the only means of conducting a search.
What about the Liberal’s constant argument that the Constitution grants people the “implied” right to privacy? Right to privacy is not found anywhere in the text, but that is their most sacred right is it not? If there is an impled right to privacy, their argument that the President has no implied powers fails. They can’t have it both ways.
Why not? It has worked for them up to now, why would they expect anything to be diffeent?
The difference is that there are people noticing their their double standard and calling them on it. But seriously, I don’t think the Chron will get it.
So, according to the Comical, The Constitution protects: the right to kill unborn babies, pedophiles, and terrorists….. but not the United states in wartime…. Hmmmm…..
I used to be a police officer and once had a crook in the back seat telling me I couldn’t take him to jail… that I was violating his “Constipational Rights!” He must’ve learned them from the Comical….

Chronicle is ignorant and a disgrace to the profession. Very few want to discuss the fact that listening to a conversation is not seizing or searching anyone’s property, which I believe was the whole jest of the 4th!
this whole subject is with out merit.
The difference is criminal law and national security. Different laws apply. No one seems to get that except those enlightened commenters on LST!
I’d like to email the Chron and call them on this ridiculousness. Anybody have an email address?
Once again the comical amuse us with their stupidity.
Here it is I always keep the constitution handy.
It would be nice if the comical would also.
Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
