Hurricane Katrina evacuees have had 16 months to start paying their own rent, but the lefty activists at ACORN and the federal judiciary don’t think that’s long enough. Neither do the editors of our beloved hometown rag, who apparently think the money should flow forever:
Judge Leon criticized a FEMA letter notifying evacuees of the cancellation of their rental assistance as “Kafkaesque” for its inexplicable and contradictory bureaucratic actions.
In ordering FEMA to resume the rental assistance, Leon wrote that “it is unfortunate, if not incredible, that FEMA and its counsel could not devise a sufficient notice system to spare these beleaguered evacuees the added burden of federal litigation to vindicate their constitutional rights.”
Unfortunately, rather than accepting Judge Leon’s ruling, FEMA chief R. David Paulison defended the decision to cut off aid. FEMA went back to court to appeal the ruling.
It seems to me that Leon and the Chron’s editors have a warped idea of due process. Here’s what the Constitution says about the matter:
nor shall any person… be deprived of life, liberty, or property, without due process of law;
I’m no scumbag ambulance-chasing lawyer, but it looks to me like the due-process issue hinges on the definition of “property.” Remember that FEMA is not taking away anything that these people already have. FEMA hasn’t seized money or other property. The agency is simply stopping the handout. So the legal question is this: does eligibility for the privilege of a social welfare program count as property?
Apparently, the editors think that defendants in court cases should simply give up and forgo their right to appeal. Unless they’re killers on death row, the kind defended by editor Jeff Cohen’s wife.

My sympathy for the Katrina evacuees is beginning to wane just a little bit…
Why are these people think they are entitled to endless assisstance because they were victims of Katrina?
They were offered a helping hand to get back on their feet. It was not supposed to be a life time commitment.
One of the problems in America today is to many able bodied people think they are entitled to sit on their lazy butts and live off the hard earned money of others.

I am surprised that some group hasn’t implied that if we don’t help these Katrina people that our crime rate will go up after all you can’t expect them to actually work for a living.

I am having trouble finding the Article in the Constitution that guarantees anybody the right to be remunerated for any losses they might incur. Guess I need to ask Judge Leon where that is.
We are assuming that FEMA wants them off the dole. From what I have seen of the bush and perry administrations it would not surprise if this is part of a plan to keep the money flowing to them with the appearance of it being court ordered but is really an administration plan.
Remember the Border Agents and if you don’t think that isn’t a plan you are FC. Wonder how much of last years RNC money came from drug donations?
I don’t even want to talk about this subject. What we think, will never play a part in what the government will do. Not to say that it does not pain me, for it does. I have developed TMJ from gritting my teeth, from sanctuary city to the Katrina effort. All levels of our government are corrupt with few exceptions. The liberals playing the PC card, our hands are tied. Truly, truly upsets me. I know this is a very broad and general statement.
I wonder what the socialist FDR would think about FEMA? At least, he made the people work for their hand outs. During Huricane Rita a tree fell in the yard. It missed the house by 10 feet but it ripped the electrical service box off the side of the house and pulled the interior wiring. I had to replace the service and the all the interior wiring.
Is this Judge now saying I have a Constitutional right to have the Taxpayers foot the bill for my repairs? Where do I sign up. I also want a $2,000.00 debit card and free rent (all bills paid) and a living allowance for the next 4 or 5 years. I not asking for anything I don’t deserve or have have Constitutional right to.
