(2) provides for the disposal of used condoms in a manner that protects:
(A) the anonymity of inmates and state jail defendants; and
(B) the health of department employees, inmates, and state jail defendants.
Reaction varied among his constituents but the most common reaction was, yeah, we needed that. Thanks, holmes (note: that’s homes in the other hood).

Sorry to throw a wet blanket on this string with those silly little annoying facts, but to be clear, the bill authorizes condoms to be distributed in prisons (by nonprofits), not just their disposal. Right now condoms are considered illegal contraband. If the bill only did the part you quoted, you’re right it wouldn’t make sense.
As for the question, “Who in the hell lobbied for this bill–and why??? So freakin ridiculous.” I’d respond: Not riduculous in the least, unless saving my tax dollars is ridiculous - I prefer to keep my money in my wallet, thanks.
HIV rates in prison are many times higher than in the outside world. Last I saw, AIDS was the third leading cause of death in Texas prisons behind heart attacks and cancer. Lifetime treatment costs can run into six figures per person for HIV+ prisoners. HIV drugs cost today 40% of the state prison system’s pharmacy budget. And who pays? You and I, though our taxes.
Like it or not, if you don’t think there’s already sex going on in prison, believe me you’ve got another think coming. You can take a reality-based approach, or a head-in-the-sand moralizer’s view. But bottom line, the state isn’t willing to pay enough guards to enforce prohibitions against in-prison sex. So if prisoners are willing to use protection, it’s ulitimately better for everybody.
