Sen. Glen Hegar (R) filed SB-438 today in an attempt to undo the damage to conservative Republicans that Gov. Perry’s forced vaccination order inflicted.
(b-1) Immunization against the human papilloma virus may not be required for a person’s admission to any elementary or secondary school. This subsection preempts all contrary executive orders of the governor.

Does the Texas Legislature have Constitutional authority to override an Executive Order fromt he Governor? I sure hope so…
One place I read that the leg can not override the executive order, but can amend the order with a law such as this where it says the executive order can not be used in the enrollment to a public school
But this law just filed, I must ask, is high school considered secondary school? How about college?
It should read :
Immunization against the human papilloma virus may not be required for a person’s admission to any institution of learning, from elementry to higher learning. This subsection preempts all contrary executive orders of the governor.
That would cover universities.
Make sure they add trade schols.

I think someone (Dan?) needs to get the jump on Gov Goodhair and pass preemptive legislation to keep him from turning us into Soylent Green. If I find out that Soylent has a lobbyist in Austin while Perry is still there, I’m going to get VERY nervous!
