Duke Lacrosse Rape Case Closed
by The Panda Man · 04/11/2007 1:53 pmAt this moment the North Carolina Attorney General is throwing out the case against the Duke lacrosse players. Significantly, the AG heavily criticized DA Mike Nifong and the handling of the case, and went so far as to propose a new law enabling removal of prosecutors from cases in some circumstances.
Unusually strong language was used by the AG to exonerate the accused and demonstrate the flimsy nature of the case against them. The legal nightmare may have finally come to an end for the Duke Boys, but some time will be required to repair finances and reputations. Meanwhile, what happens to the scandalously anonymous accuser?
Update:
The AG did not simply drop the charges due to the flimsy evidence, he actually believes that the Duke Boys are innocent.
He added: “We believe these cases were a result of a tragic rush to accuse and failure to verify serious allegations. Based on the significant inconsistencies in the evidence and the various accounts given by the accusing witness, we believe these three individuals are innocent of these charges.”
This turn of events bears out the criticisms leveled against the early persecution of the Duke Boys, and one can only hope that those responsible will be held accountable for this gross abuse of prosecutorial powers.

Hopefully the accuser loses a big lawsuit!
Historically they’ve been immune from prosecution. Maybe this time it’ll be different.
I am watching carefully for the apologies from Al Sharpton, Jesse Jackson and others for the names they called the Duke lacrosse players.
Or do they think only Don Imus must apologize for irresponsible remarks?

They can use whatever language they want about ANYBODY they want and everyone should just be happy to be graced with their presence….but should a caucasian say anything wrong at any point they should immediately apologize and let the public (i.e. whichever ethnicity happens to have been slammed) decide if they should be fired!!

Don’t hold your breath for either Reverand ( I use that term loosely) to appologize to these boys. Sadly, I am not sure there is enough money to compensate these young men for the damage to their names. Anytime anyone googles them from this time forward, they will get the garbage of this case. I can’t wait for Texas to look at Johnny Suttons activities with the same wide-open eyes.

This gold-digging beotch set these guys up from the beginning; she was high as a kite, there is no physical evidence at all, and even the other slut with her couldn’t vouch for her. One guy had a rock-solid alibi and the other 2 she couldn’t even identify at first. Plus, when she was younger she falsely accused 3 other people of rape and reported it 3 years later! WTF was Nifong thinking?
Nifong should be put behind bars with this nappy-headed hoe.

According to nitwits like Bill Maher, it’s perfectly okay to have a double standard. On Scarboro Country yesterday, he said that black entertainers have every right to us the “n” word, but white people have no right to do so.
It is an interesting society where we are told that certain types of people do not have the right to use this word or that.

I was at the American Cafe on Wisconsin Ave. in Washington DC years ago with a friend of mine. 2 young black guys were sitting behind us and one of them kept banging against my seat. I politely turned around and the other one said “what are you looking at Honkey”? My friend said “hey, would you like it if we called you a n****r”?
Both guys apologized and we actually ended up having a nice conversation with them.

If they get into a little scrape we can count on the school to disband any organizations they belong to and join the media lynch mob trying to hang them from the nearest tree, all without any evidence. I just wonder if Nifong has, in his overzealous pursuit of name recognition and re-election, considered what he’s done to the women who are truly rape victims now that they’ll be that much more reluctant to report rape cases.
For that matter, I wonder if Crystal Gale Magnum has considered the ramifications of her actions.
I doubt it in either case.

I have heard several people comment on the dismissal. I have heard regrets on what this could mean for rape victims in the future, I have heard people say that the healing needs to take place which I took to mean that Duke needs to reach out to the poor people of the city, I have heard people say that some good has come from this because it allows them to open a dialogue, BUT I have not heard anyone express any regret for what this did to the lives of the 3 FALSELY accused men or to all the members of the Duke lacross team.
The people who need healing are the 3 boys who were accused and their families. I wonder if Duke University will do anything to make it up to them since they pretty much let them twist slowly in the wind initially.
Those boys weren’t angels, or they wouldn’t have been at a party where strippers were showing up, etc. in the first place, but they didn’t deserve what they got. I bet they’re a lot more careful in the future, probably overly so.
Since Jesse Jackson has vowed to pay the college expenses of this “poor victim” does anyone want to hold their breath to see if he will pay the college expenses of the real victims - those that were falsely accused? As for suing the prosecutor, I wouldn’t be in favor of it except for the fact that the DA didn’t immediately drop the charges the FIRST time he had evidence clearing these young men. You can’t have law enforcement afraid to enforce the law, but when they find out the accuser lied or even have an inkling that they are lying, the accused should be released/charges dropped. They can always be rearrested later if more evidence comes in to support the charges.
Jesse Jackson and Al Sharpton have both recently said that imus should be fired for his irresponsible remarks about the womens basketball team.
I wonder if Jesse and Al think someone should be fired for making irresponsible and racist statements accusing young men of rape without any facts, especially now that they have been PROVEN to be totally wrong.
dcgirl - the problem I have with Nifong and ther reason he should have a penalty is that I believe he never, in good conscience, investigated this case prior to pressing charges - he seemed to go on allegations alone, and when his case fell apart, he doggedly insisted on proceeding.
In my opinion, he pressed forward with malicious disregard for the truth for his own benefit. He should be censured or disbarred just for pressing charges in the first place. He should reap substantial penalities beyond that for pressing forward when any reasonable person would have realized that he had nothing.
As for Jackson? Yeah, right. He only cares about “injustice” or “racism” if the “victim” is the right color. He won’t lift a finger to help those crackers. He will just step away quietly and move on to the next opportunity to get his name in the paper.
I hear the boy’s legal fees are around $3 million. That’s not easy to come by for the ordinary Joe who is accused these days. Wonder if there are any other pleas or convictions out there who just couldn’t afford the price of American justice?
What about the Duke faculty that publicly came out and condemned these innocent men (legally speaking of course, only God knows how dirty and amoral these men are).
I say let the faculty members who raised their voice prematurely and publicly pay their legal expenses.
Seems to me that Nifong needs to sell his house, car, and worldly possessions to help re-coup these boys attorney fees. That’ll learn him. /maybe

I would think the young lady at the center of this storm, has no assets to sue for. Such a Moral Victory would cost a large dollar amout in leagal fees, at a time when the 3 fellows have spent a large dollar amount to fight off Nifong.
The County/ State would most likely seek to offer settlement. Most likely there are limits on how much you could sue a county / state for
My idea is to sue every teacher/ professer at DUKE who signed on to the poster declaring guilt for the 3 men,for a large amount, and offer to settle for each offending teacher / professor never again works as a teacher, at any level.
Then I would like to sue Jesse Jackson, and friends who lead the lynch mob to hang the 3 young men
DA Nifong has raised the question on why a sitting DA or a sitting judge should have any form of protection for official misconduct.
I suspect North Carolina Bar Assoc, forgive the expression, remove Difong from the practice of Law in the State, or any where else.

Let’s face it…Sharpton and Jackson only come unglued when black people are offended and wronged. They are not Civil Rights leaders, they are pawns for the African-Americans in this country and they want to keep black Americans from ever stepping up to the plate because then the attention will shift away from Sharpton and Jackson…the only reason they come to any African-American person’s defense is they (Sharpton and Jackson) is to get attention for themselves.
