A U.S. District Court judge has refused to block Oklahoma’s new, tough, law designed to crack down on illegal immigration.
A new immigration enforcement law, arguably one of the nation’s toughest, is effective Thursday.
An 11th hour request for an injunction to block the implementation of HB 1804 was denied by U.S. District Judge James Payne about 7 p.m. tonight after a hearing that happened just hours before the law’s Nov. 1 implementation.
“In light of the plaintiffs’ failure to introduce evidence in support of their motion, and in light of plaintiffs’ limited argument in support of their motion, the court cannot conclude the plaintiffs’ right to a preliminary injunction has been clearly and unequivocally established,” Judge Payne wrote.
Because of his ruling, the law went into effect at midnight. What does the law do?
HB 1804 requires local and state law enforcement to check the immigration status of anyone arrested for felonies and DUIs, and then coordinate with the Department of Homeland Security to have those individuals deported. It also requires state agencies to verify citizenship before dispersing public benefits or funds. In addition, it stops illegal immigrants from obtaining driver’s licenses.
Sound reasonable enough. But the usual suspects are spreading fear.
A new state immigration law that targets illegal immigrants has created fear and panic in Latino communities across Oklahoma and will force many immigrants — both documented and undocumented – to leave their jobs and homes, Latino groups said Wednesday.
What nonsense. Legal, documented immigrants have nothing to worry about and can go about their business.
“So many Latinos have already left Oklahoma and many plan to do so, which is precisely what Randy Terrill wanted — cleanse the state,” Fennel said.
Give me a break. It’s one thing to talk about the possibility of racism influencing a small segment of the overall debate. It’s quite another to talk about “cleansing”. Statements like this are why people are afraid to even discuss it on peripheral issues.
“There’s going to be employment gaps and employers are going to suffer,” said Rey Madrid of the League of United Latin American Citizens, a Washington-based group that is the oldest and largest Latino civil rights organization in the United States.
If that is true, then let it happen. This was a bipartisan bill representing the will of the large majority of the people of Oklahoma. It is their state, their choice.
The measure also eliminates an illegal immigrant’s ability to obtain public benefits and gives state and local law enforcement the ability to enforce immigration law, including detaining illegals until they are deported.
But Fennel said Hispanic parents are pulling their school age children out of public school classrooms and Hispanic children and adults — including those in the country legally — are staying away from public health care clinics in their communities.
Again, more nonsense. Legal immigrants are going to continue working, going to school and enjoying the benefits that they are entitled to as a result of following the law by entering this country legally.
The following statement really ticks me off:
Madrid, LULAC’s representative in Oklahoma, said he plans to visit schools in Latino areas and speak to Latino youth groups in an effort to prevent them from reacting violently when the law goes into effect.
“They figure they’re punishing us and they’re targeting us,” Madrid said. “I see a lot of young people with no hope of going to college, no hope of getting a good job. They get angry.”
I heard this same guy on the radio this morning saying that we will see an increase in gangs and gang violence because of this new law. Let me say this Mr. Madrid - you are promoting violence, not attempting to reduce it, when you make inflammatory statements such as these. You are not trying to reduce violence by talking to high school kids, you are putting these stupid notions into their minds with your fear mongering.
If there is violence as a result of this law, the responsibility will lie on those that are promoting the continued flaunting of the law. That would mean you, Mr. Madrid.
Do the right thing for “your people”. Tell them to stop coming across the border illegally. And to obey the laws of Oklahoma and America.

I know for one if LULAC died because we begin to enforce our immigration laws then the this country would be a better place 10 times over….

I see a lot of young people with no hope of getting decent paying manual labor jobs, no chance of paying for college, no chance of retiring due to high tax burdens, no chance of getting speedy emergency care at hospitals. They get angry.
Shameful that The US govt and large states like Texas or CA were not at the forefront of producing this law. I am glad that OK and AZ are setting some standards and hopefully the wave will spread and the country will come to agreement. These illegals start running they are going to pressure neighboring states. We need to pressure them back to the border even if it takes one state at a time.

It is amazing how “lawbreakers” always want a chance. You do not make a good first impression when you break our laws. If you don’t like our laws then get your embassy to try to change our laws thru govenmental channels. Just don’t decide which law you want to obey and which you don’t. If we violated their space like going into their country or home, how would they feel. Look, we have laws to govern our existance. Try following them and we might accept you into our society.
Since this law has passed muster then other states should “plagerize” it and not only get the illegals moving from one state to another, but from the United States back home!
Tancredo was right when he said that our problems can be traced to illegal immigration:
Schools - stop spending money educating illegals
Health Care - stop bankrupting hospitals by forcing them to freely treat illegals
Communicable Diseases - stop allowing unhealthy illegals into the country
Crime & Terrorism - stop allowing illegals in and crime and potential for terrorists entering will go down
High Taxes - stop spending taxpayers’ money on illegals and costs will go down
Insurance rates could also go down if the costs of claims due to uninsured illegal drivers would decrease.
I saw the Governor of Oklahoma and LULAC on tv last week. LULAC was confident that the law was going to be slapped down. The Governor informed him that LULAC’s tactics mighta worked in New Jersey, but if you think that you can win here, you don’t know the people of Oklahoma.

texas needs to “cut and paste” OK new law word for word. it has already passed through one level of federal court challenge. i think it would also find bi-partisan support in Texas also.
We all know that with Perry as our gov. nothing remotely useful will be done to close the border.
Perry is a bushbot. It seems they and many others want a permanent underclass which is in the majority. An underclass who is uneducated and lazy and who will always vote for the ones who give them the most. They will win election after election. Sadly though, they have not given any thought about how all this will be paid for once we are broke.
See, it can be done. I could have sworn I remember governor goodhair in a campaign video on the border getting tough.
This will be a good test case. Other states will watch it closely as it will surely be challenged in the federal courts. They will correct any weaknesses and then offer revised versions of the bill in their legislatures shich, hopefully, will be immune to serious litigation.
I think this is a good thing that OK is doing… but I can’t help but chuckle that it’s happening in state that gets its nickname from a group of people who technically crossed a border illegally to claim land…
